My Ex-Husband has my tax files from 2004-2006. Is there any way I can get them?

My ex-husband has our married filing jointly tax files. I know I need copies of these in case I get audited. Is there anything I can do to get these files? I contacted my lawyer and he said there's nothing he can do about that.
